Please read the Vendor Terms and Conditions ("Terms", "Terms and Conditions") carefully before joining as a vendor in this website (the "Service") operated by My Company, Indian Cart("us", "we", or "our").
By submitting the order you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.
TERMS OF SERVICE
Your access and use of the Site constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Indian Cart. If you do not agree to these Terms, you must not access or use the Site. These Terms expressly supersede prior agreements or arrangements with you. Indian Cart may immediately terminate these Terms or any Services with respect to you, or generally, cease offering or deny access to the Site or any portion thereof, at any time for any reason.
Supplemental terms may apply to certain services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable services. Supplemental terms are in addition to and shall be deemed a part of, the Terms for the purposes of the applicable services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable services.
Indian Cart may amend the Terms related to the Services from time to time. Amendments will be effective upon Indian Cart'S posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.
Failure to use the Site in accordance with these Terms may subject you to civil and criminal penalties.
As a Seller, you are responsible for all aspects of items listing, health and safety compliance, certifications, compliance with laws, customer service and service delivery. You acknowledge and agree that, as a Seller, you are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals who may assist any other way that arises out of or relates to the use of this Site or the supply of services.
As a Seller listing your products in Indian Cart, you are responsible for the quality of products and their compliances with all the Federal and State Laws which includes Consumer Rights. Your product price should include GST and you are responsible for GST to the ATO if applicable.
Both Buyers and Seller agree to cooperate with and assist Indian Cart in good faith and to provide Indian Cart with such information and take such actions as may be reasonably requested by Indian Cart, in connection with any complaints or claims made by Members relating to the provision of the Seller’s services.
In the case of any disputes and in case you as a Seller are not able to follow our terms and decision on the disputes, we will have to suspend your account and your use of our services. We will try our best to promptly pass on the information to you and try to solve the issues by liaising with the parties involved and you. In the event of an outcome that affects our customer satisfaction, we may have to terminate your listing on our website.
Compliance with local laws
Sellers should understand how the laws work in their respective jurisdictions. Some jurisdictions have laws that restrict their ability to sell certain types of items to Buyers. These laws are often part of a state’s laws or regulations. In some states, Sellers must register, get a permit, or obtain a license before making any sales to the Buyers. State and local governments vary greatly in how they enforce these laws. Penalties may include fines. Sellers must review and comply with all local laws before listing in Indian Cart. While in no way diminishing the Sellers’ responsibilities under this clause, or giving rise to any positive obligation on the part of Indian Cart, Indian Cart may, in its absolute discretion, provide the Seller’s details to any government regulatory authority to assist with the Seller’s compliance obligations generally.
In order to access certain features of the Site, and to order or sell items, you must register to create an account in Indian Cart to become a Member. You may register to join as a Member directly via the Site or as described in this section.
You can also register to join by logging into your account with certain third-party social networking sites ("SNS") (including, but not limited to, Facebook, Google; each such account, a "Third-Party Account"), via our Site, as described below. As part of the functionality of the Site, you may link your Indian Cart Account with Third-Party Accounts, by either:
(i) Providing your Third-Party Account login information to Indian Cart through the Site, Services; or
(ii) Allowing Indian Cart to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account.
You represent that you are entitled to disclose your Third-Party Account login information to Indian Cart and/or grant Indian Cart access to your Third-Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating Indian Cart to pay any fees or making Ozy Online subject to any usage limitations imposed by such third-party service providers.
By granting Indian Cart access to any Third-Party Accounts, you understand that Indian Cart will access, make available and store (if applicable) any Content that you have provided to and stored in your Third-Party Account ("SNS Content") so that it is available on and through the Site via your Indian Cart Account profile page.
All SNS Content, if any, will be considered to be Member Content for all purposes of these Terms.
Your relationship with the third-party service providers associated with your third-party accounts is governed solely by your agreement(s) with such third-party service providers.
Indian Cart is not responsible for any SNS Content.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content") you are responsible for.
Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it, which includes anything you post using our Services (like shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, usernames, etc.).
A. Responsibility for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
B. Permission to Use Your Content. By posting Your Content through our Services, you grant Indian Cart a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Indian Cart function and grow. That way, we won’t infringe any rights you have in Your Content and we can help promote it.
C. Rights You Grant Indian Cart. (Here’s the legalese version of the last section). By posting Your Content, you grant Indian Cart a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content. This allows us to provide the Services and to promote Indian Cart, your shop in Indian Cart, or the Services in general, in any formats and through any channels, including across any Indian Cart Services, our partners, or third-party website or advertising medium. You agree not to assert any moral rights or rights of publicity against us for using Your Content. You also recognise our legitimate interest in using it, in accordance with the scope of this license, to the extent Your Content contains any personal information.
That sounds like a lot, but it’s necessary for us to keep Indian Cart going. Consider these examples: if you upload a photo or video of a listing on your shop in Indian Cart, we have permission to display it to buyers, and we can resize or enhance it so it looks good to a buyer using our mobile app; if you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; and if you post a beautiful photo or video of your latest handmade necklace, we can feature it - often along with your shop name and shop pictures - on our homepage, in one of our blogs or even on a banner to help promote your business and Indian Cart.
D. Reporting Unauthorised Content. Indian cart has great respect for intellectual property rights and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please follow the steps listed in our Intellectual Property Policy. If Your Content is alleged to infringe another person’s intellectual property, we will take appropriate action, such as disabling it if we receive proper notice or terminating your account if you are found to be a repeat infringer. We’ll notify you if any of that happens.
E. Inappropriate, False, or Misleading Content. This should be common sense, but there are certain types of content we don’t want to be posted on Indian Cart Services (for legal reasons or otherwise). You agree that you will not post any content that is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive or in violation of our Prohibited Items Policy, Community Policy, or any part of our Terms. You also agree not to post any content that is false and misleading or uses the Services in a manner that is fraudulent or deceptive.
The Site is intended solely for persons who are 18 or older. Any access to or use of the Site or Services by anyone under 18 is expressly prohibited. By accessing or using the Site or Services you represent and warrant that you are 18 or older.
Indian Cart recommends that Sellers obtain appropriate insurance for selling items from their list. Please review any insurance policy that you may have for your list carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Buyers.
Your Indian Cart Account and your Indian Cart profile page will be created for your use of the Site based upon the personal information you provide to us or that we obtain via an SNS (social networking service). You may not have more than one active Indian Cart Account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Indian Cart reserves the right to suspend or terminate your Indian Cart Account and your access to the Site if you create more than one Indian Cart Online Account, or if any information provided during the registration process or thereafter proves to be inaccurate, fraudulent, not current or incomplete.
You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Indian Cart Account, whether or not you have authorised such activities or actions. You will immediately notify Indian Cart of any unauthorised use of your Indian Cart Account.
The content that you share with other users is neither private nor confidential and you should not have any expectation of privacy with respect to it. Information you upload will be posted along with other personal information. You must exercise caution and common sense when submitting and disclosing information. At the very least you should demonstrate the same degree of caution when publishing personal information by means other than the Internet and cellular services.
In particular, Members may choose to share personal information such as name, age, gender, location information, appearance, messages, background personal information. This information may also be shared via third-party services (such as social networks) which interact with the Site.
By creating an account in Indian Cart, you agree that the Services may send you informational text (SMS) messages as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages at any time. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
